Welcome to aylabakery.com. This website (the “Site”) is brought to you by Ayla Artisanal Bakery LLC (“Ayla Artisanal Bakery,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Site, whether or not you make a purchase, as well as any interaction you have with the Site in any manner, or any services provided by us. By accessing, browsing, or using the Site, you agree to be bound by these Terms and by our Privacy Policy, available here. Our Privacy Policy also applies to all visitors and users of the Site, and your visit or use of our services is governed by both documents.

General Information
Ayla Artisanal Bakery LLC is a home-based bakery business operating in Brookline, Massachusetts. We offer baked goods through online orders placed on the Site and provide delivery within our designated service areas.
1. User Accounts
We may offer the option to create user accounts on our Site; however, creating an account is not required in order to place an order.

Product availability may vary, and we reserve the right to limit quantities or discontinue any product at any time.
Products displayed on the Site may not always be in stock.
We reserve the right to change product prices at any time, without prior notice.

Ordering Process
Most orders can be placed through the Site. Large or custom orders may also be placed by contacting us directly by email or phone.
When you place an order, you are making an offer to purchase products subject to these Terms.
We reserve the right to accept or decline any order at our discretion.
We may cancel any order at our discretion; if we do so, a full refund will be issued.
Pricing and Payment
All prices are listed in U.S. dollars.
We accept various electronic payment methods, including credit cards, debit cards, and digital payment services. Available options will be displayed at checkout.
Payment processing is handled by third-party processors, and by placing an order you agree to comply with their terms and authorize us to charge the full amount due.
Payment is required at the time the order is placed.
We may refuse or cancel any order if we believe it violates these Terms, involves fraudulent or unauthorized payment information, or for any other legitimate business reason.
Delivery charges may apply and will be calculated at checkout based on location and order total.
We may, at our discretion, offer reduced delivery charges or free deliveries based on factors such as order minimums, promotional offers, or coupon codes.
3. Delivery
Delivery Areas
We only provide delivery to certain locations in the Brookline area. Specifically, delivery is available only to the following ZIP codes: 02445, 02446, and 02467.
If your address is outside of these areas, you will not be able to place an order.
Delivery Dates and Location
Deliveries occur on specific dates only. You can choose your delivery date as part of the ordering process.
You must provide an accurate delivery location, instructions, and a mobile phone number. We are relying on this information to deliver your order safely, to contact you with updates or to resolve issues. By providing us with the delivery instructions, you are representing that the provided location is safe to use to drop off the delivered items.

We will strive to take a photo as proof of delivery and to share it with you, but you acknowledge that your email or mobile device may not be capable of receiving or displaying such a photo.
Delivery Responsibility
ONCE AN ORDER HAS BEEN DELIVERED TO THE ADDRESS YOU PROVIDED, RESPONSIBILITY FOR THE ORDER TRANSFERS TO YOU.
WE TAKE CARE TO ENSURE SAFE DELIVERY, BUT WE ARE NOT LIABLE FOR ANY LOSS, DAMAGE, OR ISSUES THAT OCCUR AFTER THE ORDER HAS BEEN DELIVERED TO YOUR SPECIFIED ADDRESS.
WE ARE NOT RESPONSIBLE FOR ANY INDIRECT, CONSEQUENTIAL, OR THIRD-PARTY DAMAGES THAT MAY OCCUR AFTER DELIVERY.
4. Communications and Notifications
By placing an order, you consent to receive transactional messages from Ayla Artisanal Bakery regarding your specific order. These messages may include order confirmations, delivery notifications, status updates, and other communications necessary to fulfill your order. Message and data rates may apply.

By default, text messages (SMS) to your mobile phone will be used to notify you that the order has been delivered, and to send photos as proof of delivery; And email messages will be used for confirmation that your order was received or accepted, as well as for other order updates and information about your order.

If you choose to receive communications via email or phone call instead of SMS, some messages or content (such as photos) may not be available through the alternative method.

You may not opt out of receiving these messages while you have a pending order, but you may request to receive these communications via email or phone call instead. We will not send marketing or promotional messages without your separate, express consent.
5. Cancellation Policy
Orders placed through the website can be canceled up to 48 hours before the scheduled delivery date.

Orders exceeding the quantity available online or custom orders placed directly via email can be canceled up to 7 days before the scheduled delivery date.

To cancel an order, you must contact us by sending us a message using either the email address or mobile phone number you provided when making the order. Cancellations via phone calls are not accepted.

Cancellation requests made after the applicable deadline may not be honored, and you may be charged the full order amount.

Refunds will be issued to the original payment method.
6. Refund Policy
All sales are final. We do not offer refunds for delivered orders.
7. Satisfaction Policy

8. ALLERGEN NOTICE
IMPORTANT: ALL PRODUCTS ARE PREPARED IN A HOME KITCHEN THAT MAY CONTAIN COMMON ALLERGENS, INCLUDING BUT NOT LIMITED TO MILK, EGGS, FISH, CRUSTACEAN SHELLFISH, TREE NUTS, PEANUTS, WHEAT, SOY, AND SESAME. THE KITCHEN MAY ALSO CONTAIN OTHER ALLERGENS NOT LISTED HERE.

WHILE WE TAKE CARE TO MINIMIZE CROSS-CONTAMINATION, WE CANNOT GUARANTEE THAT ANY PRODUCT IS COMPLETELY FREE FROM ALLERGEN TRACES. CUSTOMERS WITH FOOD ALLERGIES, SENSITIVITIES, OR DIETARY RESTRICTIONS SHOULD TAKE THIS RISK INTO ACCOUNT BEFORE PLACING AN ORDER. BY PLACING AN ORDER, YOU ACKNOWLEDGE AND ACCEPT THIS RISK.

9. Acceptable Use
The Site may be used only for the purpose of browsing our products and deciding whether to place an order now or in the future, and for placing orders. Any other use of the Site is strictly prohibited.
By way of example only, you agree not to:

Violation of this section may result in immediate termination of your account and legal action.
10. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, and software, is owned by Ayla Artisanal Bakery or used by us with permission and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.
This includes, but is not limited to, our logos, product images, and other materials that we own or are licensed to use. You are permitted to view and browse the content for the limited purpose of evaluating our products, but any other use of our intellectual property is strictly prohibited.
11. DISCLAIMER OF WARRANTIES
THE SITE, THE PRODUCTS, ANY ORDERS PLACED THROUGH THE SITE, AND THE SERVICES PROVIDED BY AYLA ARTISANAL BAKERY ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT THE SITE, THE PRODUCTS, OR THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETE, OR ACCURATE. ALL USE OF THE SITE, PRODUCTS, AND SERVICES IS AT YOUR OWN RISK.
12. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, AYLA ARTISANAL BAKERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE PRODUCTS, ANY ORDERS PLACED THROUGH THE SITE, OR THE SERVICES PROVIDED.
BY USING THE SITE AND/OR ORDERING PRODUCTS FROM AYLA ARTISANAL BAKERY, YOU ASSUME ALL RISKS ASSOCIATED WITH SUCH USE AND WITH THE CONSUMPTION OF OUR PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, AYLA ARTISANAL BAKERY, ITS EMPLOYEES, AND AGENTS SHALL BE LIABLE ONLY FOR DIRECT DAMAGES, EVEN IF NEGLIGENCE OCCURS. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, THE PRODUCTS, OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
13. Dispute Resolution

Informal Resolution: Before initiating any legal proceeding, you agree to first contact Ayla Artisanal Bakery at contact@aylabakery.com to attempt to resolve any dispute informally. We will make reasonable efforts to respond and work toward a resolution within sixty (60) days of submission.

Mediation: If the dispute is not resolved through informal resolution, the parties agree to submit the dispute to mediation with a mutually agreed-upon mediator. The mediation shall be conducted within thirty (30) days of the end of the informal resolution period.

Legal Proceedings: If the dispute is not resolved through mediation, either party may initiate legal proceedings. Any such legal proceedings shall be brought exclusively in the District Court of Norfolk County, Massachusetts, and the parties hereby consent to personal jurisdiction and venue therein.

Binding Effect: By using the Site or ordering products, you agree that these steps are binding and must be followed before any lawsuit or other formal proceeding may be initiated.

Individual Capacity: You agree that any arbitration or proceeding shall be limited to the dispute between you and Ayla Artisanal Bakery individually. To the full extent permitted by law: (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. You agree that you may bring claims against Ayla Artisanal Bakery only in your individual capacity.
14. Indemnification
You agree to indemnify, defend, and hold harmless Ayla Artisanal Bakery LLC, its owners, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your participation in or use of any services provided by Ayla Artisanal Bakery,

Your violation of any rights of another person or entity.
This indemnification obligation applies to any harm, loss, or damage resulting directly or indirectly from your actions, including any claims arising from your consumption of products or use of services provided by Ayla Artisanal Bakery LLC.

16. Changes to Terms
We reserve the right to modify these Terms at any time. We may update these Terms from time to time. Any changes will take effect when the effective date at the top of these Terms is updated. You are responsible for reviewing the Terms and noting the effective date each time you access the Site.
Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms that is not resolved through the dispute resolution process shall be brought exclusively in the District Court of Norfolk County, Massachusetts, and you hereby consent to personal jurisdiction and venue therein.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us. If we waive any right or provision on one occasion, this does not mean we waive that right or provision on any other occasion or that we waive any other rights or provisions.
20. Entire Agreement
These Terms, together with any documents expressly incorporated by reference, including our Privacy Policy, constitute the entire agreement between you and Ayla Artisanal Bakery LLC regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.
